Postgraduate Diploma/LLM in Medical Law

COURSE INFORMATION

This programme combines in-depth study of Medical Law with the flexibility learning.

The programme enables participants to gain specialist knowledge within a practical context whilst enhancing research skills and developing expertise in a chosen field.

Participants benefit from weekend study days where they attend lectures and workshops with comprehensive learning materials written by experts in the field and a choice of option modules which allow participants to adapt the programme to suit their professional needs and enhance understanding of Medical Law issues. The programme will be of interest to practicing lawyers, doctors, other health care professionals, administrators and those with a general interest in Medical law.

The programme is taught on a distance learning basis, with the provision of study packs, and lectures and workshops with six optional study days.

What you will study

The programme begins with the study of Legal Principles and Methodology. This module develops the research skills necessary to study at Masters level and also provides an invaluable grounding in legal research methods for non-lawyers. The remainder of the first year is made up of the remaining three core modules.

In the first half of the second year, you will specialize in two options, in areas of particular interest and practical relevance in their own fields. After successful completion of the modules, students are awarded a postgraduate Diploma in Medical Law. Those wishing to obtain the Masters have a further six months in which to complete a researched project of between 16,000 – 20,000 words on a related area allowing the exploration of a particular topic to a greater degree.

Compulsory modules

Legal Principles and Methodology in Medical Law examines the methodology of legal study, the sources of legal knowledge and the principles of research. The module also looks at the substantive areas of the laws of contract and tort as they particularly relate to issues examines in later modules.

Clinical Negligence looks at the issues relevant to a claim for clinical negligence and provides an overview of the procedural requirements. The module also considers remedies in contract trespass and judicial review.

Treatment: Consent and Patients’ Rights explores the law relating to consent to medical treatment and the patients’ right to refuse treatment. It also examines problems involving children and incompetent adults against the backdrop of patient (autonomy) and civil liberties.

Patients’ Rights and Remedies examines other avenues of patients’ redress including the NHS complaints procedure, the Health Service Ombudsman and professional bodies. The module also considers the principle alternatives to the compensation system to include no-fault compensation.

COURSEWORK AND ASSESSMENT

Each option is assessed by way of written researched assignments with a maximum word limit of 4,000 words. Students wishing to gain the LLM must successfully complete the project of 16,000 – 20,000 words.

STUDY DAYS
There are six Saturday study days built into the programme. These are non-compulsory. Study days provide participants with an opportunity to listen to guest speakers with specialist knowledge in the field, and to meet with tutors and each other.

Standard Entry:

Applicants should hold a first degree or comparable professional qualification. Candidates who have obtained extensive experience in a work-related field will also be considered.

Additional notes:

English Language
Those for whom English is not their first language should be able to demonstrate that their command of English is adequate for the course. A score of 6.5 or better in the IELTS test would be acceptable evidence.
